Terms of Service

⚠️ AVIATION SAFETY NOTICE: Relay is a ground communications management tool. It is not certified for flight-critical operations and must not be used as the sole or primary source for any flight decision. All operational decisions remain the responsibility of certificated crew and qualified personnel.

1. Acceptance of Terms

By accessing or using Relay ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you may not use the Service. These Terms apply to all users, including dispatch personnel, monitors, and administrators.

2. Description of Service

Relay is a private, web-based communications management system for aviation operations. It provides:

ACARS uplink and downlink message management
Real-time flight following and position display
ADS-B traffic overlay and weather data integration
Fleet management and dispatch coordination tools

The Service is provided for use by authorized personnel only. Access is granted by account provisioning through an administrator and is not available to the general public.

3. Authorized Use Only

You may only access the Service using credentials assigned to you. You agree to:

Maintain the confidentiality of your username, password, and MFA credentials
Not share your credentials with any other person
Log out of active sessions when access is no longer needed
Notify an administrator immediately if you believe your credentials have been compromised

4. Acceptable Use

You agree to use the Service only for lawful aviation operations purposes. You must not:

Use the Service to transmit false, misleading, or fraudulent messages
Attempt to gain unauthorized access to any part of the system or to other accounts
Introduce malware, viruses, or any other harmful code
Interfere with or disrupt the integrity or performance of the Service
Attempt to reverse-engineer, decompile, or extract source code from the Service
Use the Service in violation of any applicable law or regulation, including 14 CFR or ICAO standards

5. No Guarantee for Flight-Critical Decisions

THE SERVICE IS PROVIDED AS A COMMUNICATIONS MANAGEMENT TOOL. IT IS NOT CERTIFIED, APPROVED, OR INTENDED FOR USE AS A PRIMARY FLIGHT OPERATIONS SYSTEM, AN AIR TRAFFIC CONTROL SUBSTITUTE, OR AS A MEANS OF COMPLIANCE WITH ANY REGULATORY REQUIREMENT.

Message delivery depends on network connectivity, third-party ACARS networks, and aircraft avionics. Confirmed voice or SELCAL contact must always be the primary method of reaching flight crew in time-critical situations. The operator assumes full responsibility for all operational decisions made using or in reliance on this Service.

6. User Responsibilities

You are responsible for:

The accuracy and appropriateness of all messages you send through the Service
Compliance with your operator's standard operating procedures
Reporting system errors or anomalies to your administrator
Ensuring you are authorized to communicate with the aircraft before sending uplink messages

7. Account Suspension and Termination

Operators and administrators may suspend or terminate any user account at any time, for any reason, including but not limited to:

Violation of these Terms
Separation from the organization
Suspected unauthorized access or credential compromise
Extended inactivity

Upon termination, your right to access the Service immediately ceases. You have no property interest in your account or any data therein.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY MESSAGE DELIVERY FAILURES, DATA LOSS, OR AVIATION INCIDENTS.

10. Data and Privacy

Use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. All message content transmitted through the Service may be logged for operational and compliance purposes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Oklahoma County, Oklahoma.

12. Changes to Terms

The operator reserves the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
