THE SERVICE IS PROVIDED AS A COMMUNICATIONS MANAGEMENT TOOL. IT IS NOT CERTIFIED, APPROVED, OR INTENDED FOR USE AS A PRIMARY FLIGHT OPERATIONS SYSTEM, AN AIR TRAFFIC CONTROL SUBSTITUTE, OR AS A MEANS OF COMPLIANCE WITH ANY REGULATORY REQUIREMENT.
Message delivery depends on network connectivity, third-party ACARS networks, and aircraft avionics. Confirmed voice or SELCAL contact must always be the primary method of reaching flight crew in time-critical situations. The operator assumes full responsibility for all operational decisions made using or in reliance on this Service.

Operators and administrators may suspend or terminate any user account at any time, for any reason, including but not limited to:
Upon termination, your right to access the Service immediately ceases. You have no property interest in your account or any data therein.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY MESSAGE DELIVERY FAILURES, DATA LOSS, OR AVIATION INCIDENTS.
Use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. All message content transmitted through the Service may be logged for operational and compliance purposes.
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Oklahoma County, Oklahoma.
The operator reserves the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
